Terms & Conditions

​These terms and conditions outline the rules and regulations for the use of Taylor Middlebrook's website and massage therapy services. By accessing this website and/or booking services, you accept these terms in full. Do not continue to use the website if you do not agree to all the terms and conditions stated herein.

 

1. SERVICE & SALES POLICY - All service sales are final. This includes individual sessions, packages, series, memberships, gift cards, and promotional offers. No refunds will be issued due to dissatisfaction with services or expected results. Massage therapy is a therapeutic, individualized service, and results may vary.

 

Exchanges for services of equal or lesser value may be requested via email with at least 24 hours’ notice prior to the scheduled appointment. Approval is not guaranteed and is at the sole discretion of the practitioner.

 

2. CANCELLATION POLICY - At least 24 hours’ notice is required to cancel or reschedule any appointment. Cancellations made less than 24 hours in advance will be charged the full service fee. No-shows and same-day cancellations are non-refundable. Late arrivals will result in a shortened session ending at the originally scheduled time, with no adjustment in fee.

 

3. GIFT CARDS & SPECIAL OFFERS - All gift card, gift certificate, and promotional offer purchases are final and non-refundable. These must be used before the expiration date. Expired certificates cannot be honored or refunded. Some services within a package or certificate may be exchanged for a different service of equal or lesser value, pending approval.

 

4. REFUND REQUESTS - Refunds are not offered for any completed services. Requests for refunds or service exchanges must be submitted by email to info@taylormiddlebrook.com within 14 days of purchase. Refunds may only be considered for prepaid services in cases of practitioner illness, injury, error, or business closure. Approval is not guaranteed. Approved refunds will be issued to the original form of payment. Processing times vary by financial institution.

 

5. SEXUAL MISCONDUCT POLICY - Massage therapy is a professional, non-sexual service. Any sexual comments, jokes, advances, inappropriate touch, exposure, or conduct that makes the therapist feel unsafe or disrespected is strictly prohibited. If such behavior occurs, the session will end immediately with no refund. Future services will be denied, and law enforcement may be contacted. We reserve the right to refuse service to anyone at any time.

 

6. CONSENT & COMMUNICATION - Massage is a consensual process. Either the client or therapist may end the session at any time. Respectful communication is required at all times. Clients should speak up if they feel uncomfortable at any point. The therapist will honor client boundaries, apply professional draping techniques, and remain within the legal scope of massage therapy.

 

7. LIABILITY WAIVER & INFORMED CONSENT - By receiving massage therapy services from Taylor Middlebrook, you acknowledge and agree to the following:

 

Voluntary Participation & Informed Consent - You understand that massage therapy is a non-invasive, therapeutic service intended to promote relaxation, stress reduction, pain relief, and increased circulation. You voluntarily consent to receive massage therapy services and affirm that you understand the nature of the treatment.

Medical Disclosure - You agree to provide accurate and complete information about your medical history, medications, conditions, surgeries, allergies, and physical limitations. You understand that withholding relevant health information may pose a risk to your safety. Taylor Middlebrook will not be held liable for any injury, aggravation, or adverse outcome resulting from your failure to disclose such information.

Acknowledgment of Risk - While massage therapy is generally safe, you acknowledge there are potential risks, including but not limited to: soreness, bruising, increased pain, allergic reactions to oils or lotions, and aggravation of existing conditions. You release Taylor Middlebrook from all liability for injury or harm arising from known or unknown risks associated with massage therapy.

Indemnification & Hold Harmless Agreement - You agree to indemnify and hold harmless Taylor Middlebrook, any affiliated contractors or entities, and property owners (for in-home sessions) from any claims, damages, or losses arising out of or in connection with the massage services provided, except in cases of gross negligence or intentional misconduct.

 

Massage is Not Medical Treatment - You understand that massage therapy is not a substitute for medical examination, diagnosis, or treatment. You are encouraged to consult with your healthcare provider before beginning any new bodywork regimen, especially if you have a complex or serious medical condition.

 

Right to Refuse or Terminate Services - Taylor Middlebrook reserves the right to decline or terminate services for any reason, including concerns about medical conditions, hygiene, boundary violations, or inappropriate behavior. You also have the right to end the session at any time, for any reason.

Legal Capacity & Agreement - By booking or receiving services, you affirm that you are at least 18 years old, of sound mind, and legally capable of giving consent. If services are booked for a minor or dependent, the parent or guardian assumes full responsibility and liability and must be present for the session as required by law.

 

8. IN-HOME MASSAGE POLICIES - Clients must provide a clean, private, and safe treatment space free from pets, distractions, and hazards. Secure and accessible parking must be available. The therapist may cancel or terminate a session without refund if the environment is unsafe or if the client's hygiene, behavior, or intoxication poses a problem.

 

9. DEVICE & RECORDING POLICY - All phones, tablets, smartwatches, and recording devices must be silenced or turned off before the session begins. No recording—audio or video—is permitted without prior written consent. Unauthorized recording may result in immediate termination of the session and legal action, without refund.

 

10. HIPAA & PRIVACY - Client health information is confidential and treated as Protected Health Information (PHI) under HIPAA. Records will be stored securely and only shared with written consent or as required by law. Clients have the right to access their records.

 

11. EMERGENCY CONTACT - Clients must provide a valid emergency contact before receiving services. In the event of a medical emergency, emergency services and/or the emergency contact may be notified. This ensures the safety of the client and therapist during in-home sessions.

12. HYGIENE POLICY - Cleanliness and comfort are foundational to the healing process, and both therapist and client are responsible for maintaining this shared space of care.

i. Client Hygiene Expectations - To ensure a safe, respectful, and comfortable environment, clients are expected to maintain proper personal hygiene before their massage session. Please arrive freshly showered, with clean skin and clothing. If you have been sweating, exercising, working outside, or exposed to strong odors (e.g., smoke, perfumes), please bathe prior to your appointment. Sessions may be rescheduled or shortened without refund if hygiene issues interfere with the therapeutic environment.

ii. Therapist Hygiene Commitment - Taylor Middlebrook maintains the highest standards of cleanliness and professionalism. Fresh sheets and sanitized equipment are used for every session. Hands, forearms, and tools are washed and sanitized thoroughly between clients. The therapist will arrive freshly showered, in clean attire, with trimmed nails, and will wear a mask upon request.

13. AGREEMENT & ACKNOWLEDGMENT - By using this website or receiving massage therapy services, you agree to abide by these policies and terms. You acknowledge your responsibility to communicate openly and maintain respectful behavior throughout all interactions.
